    Proskauer Rose LLP Top Law Firm in Country represented NBA and Dallas Mavericks in the Roy Tarpley Jr case. General counsel for the NBA Mr. Gans who threaten me during the pre-determination phase of the investigation that if I (EEOC) went reasonable cause against NBA then they will have Chair Earp-Campbell brought before Congress and betten-up for same. I told Mr. Gans I didn't care the facts show reasonable cause and know matter what he threatened it wouldn't change. After that the fix was in for NBA and Dallas Mavericks. Commissioner Silverman called Nancy Boyd Deputy Director of EEOC-NYDO to undermine the conciliation. Nancy Boyd had Trial Attorney Michael O'Brien call Mr. Gans and ask for a new position statement because the first one wasn't credible. Spencer H. Lewis District Director then tried to negotiate with Proskauer Rose LLP directly. Then Chair of the EEOC Earp-Campbell had her Admin Asst conduct the conciliation. The fix was in not to litigate the Roy Tarpley Jr v. NBA and Dallas Mavericks. Once the complaint was amended to add Dallas Mavericks Proskauer Rose/Mr. Gans represented Dallas Mavericks also. Conciliation failed and the right to sue was issued. Former EEOC Vice Chair Leslie Silverman to Join Proskauer Rose in Washington, D.C. … Proskauer Rose. Now we understand!!!

    The government i.e. (EEOC/OFCCP/MSPB/DOJ) and members of the current administration are allowing employers to have a free hand to discriminate. In their minds this will help the economy. The question is why are our Senators and Representatives allowing this to happen? Could they have been paid-off and/or owe favors? The above agencies are only processing complaints. Employers know the government isn't interested in Race discrimination.The Mayor of NYC has hired ex-EEOC/OFCCP/IRS managers to fix any complaints filed against the NYC and/or his corporation. The fix goes all the way to Washington DC with other agencies to include the EEOC. Some investigation are just smoke screens to hide corruption. Bloomberg Inc's attorney is the ex-general counsel for the EEOC Washington DC. EEOC for hire before, during and after government service???

    What about Former EEOC Senior Federal Investigator Ricardo Jones who exposed corruption and fraud at EEOC-NYDO and nationwide??? Terminated by EEOC in retaliation for the following: The Law firm of Jackson Lewis LLP of NYC is involved in corruption with the EEOC's NYDO. If an investigation against Jackson Lewis' clients looks like it will be reasonable cause the management at EEOC-NYDO will suspend the investigation and allows the complaint to be assigned to Mediation(ADR)with no cause finding. Robert Lewis of Respondent Law Firm Jackson Lewis LLP was a contract mediator at NYDO of EEOC. Fox in chicken house!!!

    On/or about late 2006 early 2007 the Legal unit of EEOC-NYDO conducted a training on the uselessness of filing a Race (Black) complaints. Training attend by Legal staff and local attorneys and NELA president Ann Golden her husband attorney Wayne Outten of Law firm of Outten & Golden LLP of NYC other attorneys present. Guest speakers were Top Female attorney from Proskauser & Rose LLP and former Intern/Clerk for federal appellate court (Black Female) both advocated for not filing a Race (Black) complaint to the attendees. In attendance was Regional Attorney Elisabeth Grossman, and Lisa Sirkin supervisory attorney for EEOC-NYDO. Many attorneys were present to include one Black male attorney

    Many of the so called Black leadership and Black elite are in denial about discrimination against Black people (Field Blacks and/or working class Blacks). The Federal government (EEOC/MSPB/DOJ/OFCCP) has done very little to enforce civil rights laws to protect Blacks from this kind of employment discrimination. The true stats on Black unemployment and the lack of enforcement by the above agencies are the cause.

    Please read “You are Being Betrayed by the US Government” by the late Sam Wright Jr, its online free. Many Law firms benefit from the corruption at the EEOC. Most of the lawyers at the EEOC have knowledge of the corruption there. If the people fail to expose and reform the corruption at EEOC/MSPB/DOJ/OFCCP then we're just as corrupt as the aforementioned. During the Great Depression corruption was accepted like today. We need Untouchables to clean up the corruption in government.

    During 2009 the Acting Chair of EEOC then Stuart J. Ishimaru came to the NYDO of the EEOC an spoke on Race discrimination. He stated he didn't know how Race (Black) discrimination could be enforced in the future. Spencer H. Lewis Jr, District Director of EEOC in the northeast agreed. This was after a presentation on the progress of lawsuit filed though EEOC for Race discrimination for Asian Officers of the Port Authority Police. Acting Chair Ishimaru couldn't remember when the Civil Rights Act of 1964 was enacted. Ishimaru stated it was 50 years ago. He missed the date by 5 years. He's was the Top Civil Rights gate keeper for the Federal Government on employment related matters. When asked about why only one Black Attorney working for the EEOC in New York he said this is a problem throughout the whole national EEOC. The lack of Black Attorneys. At the time the NYDO of the EEOC had four times as many Asians Attorney as Black Attorneys in the largest Black community in the country.

    Its how many case for Black people are resolved in federal court and what are the damages that count. EEOC is just a smoke screen to cover-up a corrupt agency against Black people. How many Black attorneys at the EEOC nationally??? Jacqueline A. Berrien is supporting the corruption at her own agency. She wants more Black cases/complaints dismissed (ULP filed by EEOC union against same). Is the Noose the only way to prove Race (Black) employment discrimination??? The question is which law firm represents that East Taxas company and do they have connections in Hq's EEOC or on the Senate oversite reviewers???

She in a tough re-election race in the state of Washington. All the voters should let her know we're not going to accept this corruption at Civil Rights government agencies ie: EEOC/DOL/NLRB/OSHA/CDC. Other Senators to contact on the committee: Barbara Mikulski Senator from Maryland large Black communitity who has knowledge of the corruption against Black people at the EEOC. The replacement for Hillary Rodham Clinton former Senator from the Largest Black communitity in the country NY State should have been briefted about the above corruption at the EEOC. We as Black people are to blame for the above. We let are elected representatives to include the Black representatives to only fight for Education with No JOB/CAREER rights to protect what Education entitles us to receive as citizens.

    Many EEOC managers and/or attorneys are advocates for Big business and/or big law firms. They are not supporters of civil rights. They only support civil rights when it benefits their own groups except for Blacks. Check the employment roles of top law firms and major corporations with cases at the EEOC. You will find ex-EEOC attorneys and managers in private sector and/or state and local government. Complaints are fixed while these ex-EEOC roques are still in government service. The Atlanta GA office of the EEOC is one of the worst with ties to Honda Manufactoring involving harassment and/or dicrimination against their Black employees. EEOC Atlanta has turned a blind eye to Honda's illegal acts against Blacks. Who from the EEOC is going to work for Honda or working at same???

    EEOC is an advocate for corporate american. There's a conspiracy between govenment lawyers and respondent law firms ie: Jackson Lewis/Proskauer and Rose and many others. They creat work and fix decisions for personal gain. Chair of the EEOC can only be confirmed (by senator Tom Harkin) if she dismisses all Black complaints. The corrupt EEOC union has now withdrawn their ULP against same to FLRA. The ULP(questioned the timing of extra (50) dismissals per investigator per year) and FLRA is a joke to start with. Denial and or dismissing Race (Black)discrimination nationwide won't save the economy. If this criminal action was done to any other group but Black people the public wouldn't accept the government misconduct ie: SEC, SALLY MAE.     Subject: Re: Proskauer and Rose donating money to Clyde Lo-chin's Steel drum club.

    Clyde Lo-chin (currently mediator in Tampa, FL EEOC) recruited me (Ricardo E. Jones) and a friends (Robert Brown) of the US Army Reserves to apply for positions at the EEOC-NYDO as investigators on or/about early 2001. Clyde had meetings with us both to prepare us for the interviews with members of management of EEOC-NYDO. I never believed that I was going to be hired despite my background in Law Enforcement and investigation. Clyde said not to worry you'll get hired. I was hired sometime the first week of April 2001. After I was hired Clyde was working on a big case against Ralph Laren Polo involving a large amount of Black employees. Sometime later Clyde asked me to attend one of the settlement conferences at Proskauer and Rose where I meet top negotiator Paul Salvator Esq, and other attorneys for Polo. Later after the conference I was contacted by Paul Salvator of Proskauer and Rose. Paul asked if I had a case with the respondent MBIA. Paul wanted me to set-up a similar conference to settle to case. I did and it settled for $650,000.00 in less than 90 days. Clyde Lo chin had admitted to me that he asked Paul Salvator to have Polo to donate $5000.00 to Clyde's Steele Drum club and he did.

    Clyde Lo chin has a relationship with Nancy Boyd who at the time of my hirer was Enforcement manager, and later Deputy Director of the EEOC-NYDO. Nancy Boyd was fixing cases for Vice Chair of EEOC Leslie Silverman for the Proskauer Rose Law Firm. Leslie Silverman left EEOC and became a partner of Proskauer and Rose in Washington DC and works with Paul Salvator of Porskauer and Rose of NYC.

    The EEOC could have fixed the racial problems of this country, but it was infiltrated and/or staffed with segregationist/racial Bigots/Uncle Toms/Aunt Momas and they 're still there today. Many at the EEOC aren't supporter of Civil Rights and/or Rule of Law for all (Justice under the Law). No Civil Rights attorneys work at the EEOC and/or other government agencies.     The Presidents appointee Jacqueline Berrien chair of EEOC is supporting “JIM-CROW II LAWS” at the Rogue EEOC. Black people are not equally qualified for employment by the non-enforcement of the CIVIL RIGHTS ACT OF 1964 as amended by the EEOC. This is what Ms. Berrien has brought to the EEOC nation wide. Ms. Berrien has required the dismissal of a additional 50 complaint per investigator at all EEOC office. If any investigator refuses to dismiss the additional 50 complaints they with be disciplined.

    The History of this country has shown that white people have brutalized and enslaved Black people. White people some still think they have some rights to oppress Black people. I can give many examples of the above. My point is most white people have recieved the benefits of the above oppressions. I heard no white’s talk of admitting to any of the above. Many of US Black’s are mixed racially as a result of slavery, rape due to slavery and Jim Crow Laws to hide en-human ways we were brutalized. Many Black’s choose to copy the worst ways of white people. We as Black people must always chose right over corruption and abuse due lust for power.

    The noose incident was the end of my career at the Rogue EEOC. I’m proud of all of my actions as a represenative of the people of the true America. I learned how to be a true Federal Investigator from the US Army at Ft. Gorden Ga, and Ft. McClellan AL. US Army Military Police School and Military Police Investigation School. I Graduated on the Commandant’s List from MP school. After one year at Ft. Hood TX as a Line duty MP with the First Cav Division MP’s, I was selected to became a MP Investigator. I was 19 years old when I first became a Federal Investigator for the US Army. I saw the good and the bad both nationally and internationally. I graduated from the two week course at the DEA, in New York City in 1978. This training is what helped me to identify the corruption at the EEOC, MSPB, FLRA, OFCCP, DOL and DOJ office of Civil Rights. I was taught how to expose conspiracy. The EEOC made a big mistake in hiring a real qualified Federal Investigator who they couldn’t train to be corrupt like the rest of them.

    Mary 1 week ago in reply to Ricardo Jones I filed a charge with the EEOC in 2006, I received a call from the investigator today nearly 5 years informing me of a “right to sue letter” being sent to me. I am saddened by the mishandling of my case and the length of time the EEOC has allowed elapsing. I file for sexual harassment which I have a tape recording of the harasser comments. I also filed discrimination and retaliation with evidence and witnessess. The EEOC has refused to give me a finding. Why? I don’t know. Where can I go for help. Chicago, Il

    This is an attempt to ensure  my rights are respected,  to restore my reputation, to seek justice and to expose corruption and the injustices in the federal workplace.  Please be advised that I am seeking assistance because of the following reasons below:

    I have not received a response regarding the  request that I sent on August 16, 2011  to the United States Secretary of Labor Solis.

    This issue regarding the FMLA and false medical diagnosis wads reported to the  Wage and Hour Regional Office in Atalanta Ga. November 2010.
    For the last few weeks, I have called the number provided 202.693.0668 and left several messages for Chiquiah Rose, a Specialist in the  DOL Wage and Hour Division, she would return NOT return my call.  Wednesday, she finally answered the phone and after realizing it was me,  she indicated she would call me back in 15 minutes after she found information regarding my correspondence.  She never called me back.  She wanted to know how I got her “direct” phone number.  I informed her that someone in the Secretary of Labor’s office gave me her phone number and directed me to her to follow up on my request regarding the reinvestigation. 

    Mrs. Vivian Rivera in the Regional Office located in Atlanta Ga,  ignored the alleged abuse of authority beginning November 2010. See the forwarded email to Mrs. Rivera below.  Without a reinvestigation, under the orders of a Mrs. Davidson who works in Washington DC, Mrs. Riveria revised the FMLA Narrative June 22, 2011.  I believe federal employees are  covering up the criminal actions of the federal investigator.  The investigator never informed me she had documented the false medical diagnosis. I would have never known about it and therefore it indicates it was done deceitfully and with malice.   I requested a copy of the record under the FOIA because I became  suspicious. The investigator’s actions towards me sent up a red flag  she was not impartial during the investigation and was working to help the employer.  The FMLA Narrative has been Amended without a reinvestigation and is evidence of everything I am stating.  Upper management also ignored the violation of federal regulations because they want to cover up the investigator’s actions.  This is unbelievable because they don’t have a document to support what they are documenting in the FMLA Narrative.  Still, the FMLA Narrative is proof because it contradicts the Federal Regulations and proves there  conspiracy to cover up improper employment procedures within the federal workplace.

     I have documentary evidence that federal employees are committing crimes  under the color of the law . Intentionally using their authority to ignore complaints is unethical.  This abuse of authority is negatively impacting the black community. The average African American citizen would not have known how to handle this issue or other issues involving deception by the very people who are suppose to enforce federal laws and regulations.  It appears that there no consequence when the investigators justify the actions of the employers who violate federal laws and federal regulations.  It also appears federal investigators  are being paid to look the other way. Why would they risk  their careers if they are NOT being paid off?  Why would federal investigators and upper management fabricate a federal document to serve as evidence to justify the actions of an employer who clearly violated the federal regulations?

    Contact me ASAP if you need copies of documents to serve as documentary evidence regarding federal employees’ unethical actions.  I have documentary evidence that EEOC investigators lie and scheme to avoid going forth aggressively to ensure employers comply with federal regulations.  I have be collecting documentary evidence since 2009. It’s time to expose the corruption regarding EEOC, DOL Wage and Hour Division and other federal agencies failing to investigate the complaints of Black people who file discrimination complaints and other complaints.

    The last two years have bee a nightmare and I am ready to wake up.   If EEOC had investigated my complaints, the FMLA issue would have never happened. Employers do NOT respect EEOC because they know it’s an illusion to fool  and mislead citizens into thinking they have route to justice knowing they do not.  I was deceived into thinking  a fact finding conference  was being held June 24, 2011 when it appears that I did NOT have a proper fact finding conference. I was NEVER sworn in and the conference was held by telephone all parties in different locations including the investigator located another state.   As a American Citizen, my rights under the Constitution are being violated by the people who are supposed to be enforcing the federal laws and regulations.  Does anyone have Rev. Al Sharpton’s contact information? Enough is Enough.

    Dear EEOC Chairwoman,
    Propaganda and wishful thinking are no help to those employees of the EEOC and those who come before the EEOC in hopes of finding justice and the expectation of fair play. Your predecessors have brutalized the people who have come before this Commission. As a former EEOC Administrative Judge you continue to allow the EEOC to fight what is the single largest disability discrimination case today in our judicial system – mine. For eight years you have allowed your attorneys, Sherlock et al., supervisors, Siegal, to state on the administrative record that I will be dead by [the hands of the EEOC]or my own. Encouraged perjury, lies and outright fabrication. Illegal ex-parte hearings, failure to legally place me, a judge, in the proper appellate forum – and keeping my case in OFO even after they knew I filed in federal court for eight more months in hopes that I would die first! This does not include the fact that several people were taken from OFO to work against me on my case and then placed back into OFO or sent to other departments where everyone was aware of how hard this Agency attempted to kill me, See you tube Bullock v EEOC. Your judiciary is absolutely corrupt and continues to be. You turn a blind eye to the transgressions of others. The EEOC has damaged more decent hard working people than they have helped. You have destroyed lives in a cavalier fashion, behavior you have no intention of changing. Because you are an institution you collectively absorb the guilt which means that no one person can be held accountable. Yet, in reality the “Buck” stops with you! You are accountable, whether you like it or not. When you continue to employ individuals like Sherlock, who turn facts into fantasy because his instructions from the Chair are to win at all costs, you can only get what you expect – despicable human beings. During my tenure with the EEOC I witnessed more corruption in the EEOC Judiciary than I experienced during my entire legal career.
    The EEOC is in constant violation of the laws. You have administrative judges (attorney examiners) give legal advise and make decisions that are not licensed to practice law. As a result their decisions are not binding and do not have the force and effect of the law. In the Los Angeles Office alone you have five (5) unlicensed AJs.
    You personally are aware of this problem yet you do nothing to change it. The only true chairperson for this Commission is one who is hard-wired for justice and fair play. No matter what you say – I do not believe this person is you. I have read and listened to so many people who have been incredibly wronged by the Agency’s decisions, that no Chairperson has credibility. When you tell the judges to move the cases along (get rid of them any way they can)you have destroyed an individual’s right to be heard. There is not a prayer for justice. As the Civil Rights Commission before, the EEOC has made the same mistakes. The EEOC actually copied their procedures. The EEOC has failed. It failed me, a disabled judge, in your own system through the likes of Sherlock, Inzio and Perry and others who are without moral compasses. My case is not the exception but one of the most egregious. I believe you need to read the enabling legislation of the EEOC – you ARE designated as the Model Employer! Yet, when it comes to your own employees your organization has been cited as being the single most retaliatory agency in government. Those in power rewrite history and make up lies to suit their own needs. You have no idea what you signed up for and honestly I do not believe that to date you have proven the leadership skills that are necessary to turn this Agency around. It would take one incredible person to be the Change Agent this Commission needs. Are you really up to the job? Otherwise all you can do during your tenure is to perpetuate the corruption and abuse of the EEOC’s legal system and your mission – to eradicate all vestiges of discrimination is only a joke. Clean up your own Agency since it affects the lives of so many people. Unfortunately, only time will tell as to whether you are capable of walking the talk. Listen to those who have been abused by your Agency and tell me you are proud to lead the EEOC.
    I am sorry I have to state what everyone else knows. Time will tell what kind of leader you are. How many people will continue to suffer under your tenure and will you really care – this is the question. I wish I could be more hopeful, but I am a realist by nature. I have seen and experienced the worst of this Agency.

Former Vice Chair Leslie Silverman Esq, fixed decisions for her present employer Proskauer Rose law firm while she was a commissioner at the EEOC. This information was given to my by Nancy Boyd then Deputy Director of the EEOC-NYDO and Nora Curtin Trial attorney/former regional attorney miami-EEOC. Ms. Silverman was a former staff member of the senate sub-committee that over-saw the EEOC. She currently is using her contacts to fix complaints and issues at the EEOC of Proskauer Rose law firm Washington DC. Assistant General Counsel for the EEOC James Lee is a sexual preditor who has sexually harassed many females at the EEOC over his tenure. This information was given to me by Lois Bramble legal clerk at the EEOC-NYDO. Luis Graziano Trial Attorney at EEOC-NYDO has taken money to fix decisions and conciliation at the EEOC. He’s a close friend of Assistant General Counsel James Lee of EEOC-Hq’s and is also on the take with Graziano. Nancy Boyd fixed decisions for Leslie Silverman at the EEOC. Nancy Boyd is also a close friend of and ex-subordenate of Enforcement Manager Electra Yourke of EEOC-NYDO who worked for Elleanor Holmes-Norton former head of EEOC and NY City Commission of human rights. Ms. Yourke is a racist bigot known by all in NYC and Washington DC. This information was given to me by Ricardo Cuevas Esq and admin judge at the EEOC-NYDO. Clyde Lo-chin Mediator EEOC-Tampa FL, received a bribe from Paul Salvator Esq for Proskauer Rose law firm representing Ralph Loren Polo and now working with former EEOC vice chair Leslie Silverman in Washington DC. This information was given to me by my friend Clyde Lo-cin Mediator at Tampa FL EEOC.

    what we elected the president to do? The president has appointed bad/corrupt judges and heads of these civil rights agencies. The EEOC oversee’s the state and local civil rights agencies. The president appointed the head of the EEOC (Jacqueline Berrien) who is a friend of his wife and went to Harvard Law School with the first lady. The president has made a lot of bad appointments just as Bush did. Whom benefits from these bad appointments Big Law Firms and Bad employers ie: Corporations, Companies, State, county and city governments. The adminstration is bending over badwards to look the other way to let Bad employers break the laws so they will creat more jobs. Going to court early my save you time but won’t resolve your discrimination complaint. This is about government in bed with Bad employers for kick-backs and positions for themselves and their friends. This is Gangster Corruption of our country. Our elected officials know whats going on and benefit from this corruption. Business couldn’t serve unless the government looks the other way and let them break the employment laws. Force the president to do his job and make his federal agencies do their jobs not just dismissing complaints. What has the DOJ office of civil rights done nothing.     In a letter dated June 15, 2008 and an email dated June 29, 2008, after having received the automated right to sue letter from EEOC-Charlotte District Office, Mr. Morrow requested an appeal with Mr. Carlos Villescas (Deputy District Director – EEOC-Charlotte District Office). Mr. Morrow conveyed that he originally submitted a dual treatment and impact charge. Mr. Villescas reviewed the case for several days and told Mr. Morrow on July 11, 2008 that the case was only investigated as a treatment case and not an impact case, and further explained that it could have been due to lack of resources. Mr. Morrow then explained to Mr. Villescas in writing and verbally that his expectation was that all charges would be fully investigated and not ignored. After a week of deliberation, Mr. Villescas returned a letter to Mr. Morrow indicating that his reconsideration concluded and that he would not change the finding. Mr. Morrow realized that his impact claim was being ignored by the EEOC.  In August 2008, Mr. Morrow contacted Ms. Sharon Jamison with the EEOC Office of Field Management and she advised Mr. Morrow to submit a written request for substantial weight review to Mr. Reuben Daniels (District Director, EEOC-Charlotte District Office). Ms. Jamison indicated that a substantial weight review letter should be granted if 1 or more of the following conditions are met: 1) procedures, regulations, and laws were not appropriately applied, 2) evidence was not considered, or 3) flagrant misconduct by the investigator.  In October 2008, Mr. Morrow submitted a substantial weight review request letter to Mr. Daniels outlining the case particulars and that his impact claim was never investigated. Mr. Daniels returned a letter to Mr. Morrow indicating that a “full review was conducted” by Mr. Villescas.  Mr. Morrow then submitted a FOIA request to the EEOC-Charlotte District Office, and Ms. Lynette Barnes provided all disclosable documents in the enforcement charge file. As evidenced by Mr. Morrow’s discussion with Mr. Villescas and Mr Morrow’s review of the FOIA released documents, it became evident once again that the impact charge was never investigated and it was not merely personnel incompetence but primarily blatant misconduct.  In November 2008, Mr. Morrow sent Ms. Naomi Earp (former EEOC Chairman) an email and followed up with two voicemails in regards to his case. Ms. Earp was unresponsive to Mr. Morrow’s communications. In January 2009, Mr. Morrow submitted a detailed written color of law charge via certified letter/return receipted to the USDOJ Civil Rights Division Criminal Section detailing the case and communications with SCHAC and EEOC-Charlotte District Office personnel. After repeated telephone follow-up calls to the USDOJ, it was determined that the letter was lost and never arrived at the Criminal Section Office despite receiving a return receipt.  In March 2009, Mr Morrow resubmitted the color of law charge in a letter dated March 26, 2009 and specifically requested that under Sections 242 and 241 of Title 18, that the USDOJ investigate the actions or inactions of the EEOC and SCHAC in his discrimination case.  On June 15, 2009, Mr. Morrow received a letter (DJ 144-67-0) from Ms. Aneesa Kahn (USDOJ -Civil Rights Division Criminal Section) indicating that Mr. Morrow’s complaint “does not involve a prosecutable violation of federal criminal civil rights statutes.” Mr. Morrow called Ms. Kahn to get more information as to why she couldn’t investigate, and Ms. Kahn indicated that they do not have the jurisdiction and primarily deal with police brutality or other abuses by law enforcement officers. Ms Kahn further indicated that my allegations are prosecutable, but not through her office.  On June 22, 2009, Mr. Morrow sent Attorney General Eric Holder an email at askdoj@asdoj.gov outlining his complaint and followed up with a telephone call to Mr. Holder’s office. It determined after speaking with the administrative assistant, that Mr. Holder’s emails and telephone calls are filtered and redirected to appropriate offices and personnel. Mr. Morrow did not receive any response from his efforts to elevate his case with the Attorney General. Also in June 2009, Mr. Morrow called the USDOJ hotline and inquired as to which USDOJ office would be appropriate for investigating his case. Mr. Morrow was referred to the Employment Litigation office, and left several voicemails requesting that an attorney return his call. Ms. Cynthia Jones left Mr. Morrow a voicemail, and Mr. Morrow spoke to Ms. Jones on June 30, 2009. In this conversation, Mr. Morrow conveyed to Ms. Jones that his disparate impact claim was never investigated as confirmed by a conversation with the EEOC-Charlotte District Office (Mr. Carlos Villescas). Ms Jones indicated that the USDOJ does not have anyauthority over the EEOC (e.g, color of law), and that discrimination charges are routinely ignored because EEOC offices across the country are understaffed.  In July 2009, Congressman John Barrow submitted a congressional inquiry on Mr. Morrow’s behalf to the USDOJ and EEOC requesting that the following issues be reviewed.1) evaluate for color of law violations by EEOC and USDOJ officials (Section 242 of Title 18)  2) review the recorded conversation with the USDOJ where it is acknowledged that cases are routinely ignored due to lack of resources.4) review Mr. Morrow’s case file to ensure that all of charge were or are investigated In January, 2010, the USDOJ responded with a letter indicating that the allegations did not constitute a prosecutable violation of federal criminal civil rights statues.

    I (RICOHENRY) had some direct contact with General Counsel of FLRA Ms. Julia Adkin Clark and her Deputy both are a waist of tax payers money. This is an example of who you know to get a high paying government position and not be qualified for it. President Obama made her appointment with many other just like Ms. Clark useless. The President is paying back all those who helped him get elected. The affect on the public doesn’t matter the president has a debt and an fraud will do. To put someone like Ms. Clark in-charge of Union Police for the government is why WI politicians are distroying governemnt Unions. Its the same at the EEOC and other governement agencies Jacqueline Berriens chair of the EEOC is useless also. Ms. Berrien went to Harvard Law school with the First Lady. How can we have faith in a President who cares so little about the working class??? The President had to Bailout the DOL wage and hour division by sending all complainants to the ABA. What are all the DOL attorneys and investigators doing??? NOTHING!!!

    If the president is politician and not a leader then we have made a BIG mistake. He’s supposed to be the leader of this country and the free world. I don’t care that the president looks Black. No passes for Black people in this life and/or this world. What we must have is a proven strong leader as president.  The president has no record of leading anything but a short career as a junior senator and a community organizer.  C4C is possibly one of the only groups that could bring about real change for our people Black people and this country. The administration is acting out of Panic. The country is close to possible Anarchy. The ruling class will do and are doing as the Nazi did in Germany. They must blame some group for the problems of this country sooner or later. Which group will end up like the Jew’s of WWII Europe?

    Some may take this the wrong way but we’re either part of the problem or part of the solution. This country was founded on Racism and Racism is destroying this society.

    Our president doesn’t care about Justice for working class people who look like himself or his wife and daughters. The president appointed his wife’s friend(Jacqueline Berrien) to head the corrupt EEOC. Berrien is a black attorney from the NAACP legal defence fund of NYC but she for Bad employers who discriminate against Black people IE:corporations, companies, Bad government agencies like her own(EEOC) and others to include state and local governments. This is the best a black looking president will do for Black people. I tried to fight for all people but Berrien’s fired me for not dismissing Black complaints. Many Black attorneys and investigators at the EEOC along with the others are just dismissing all Black complaints. This is what the president wants. They think we all are just playing the RACE card. The judges in federal court feel the same way along with most attorneys in this country.

    Dear Friends,

    The gestation period for this particular blog has taken far too long, it is inspired by the most banal, and for the uninitiated, most questionable of all motives – personal outrage. Organizations become dinosaurs overnight because they fail to listen to the groundswell of an underground movement that has become organized and loud in the varying complaints of a system that perpetuates corruption. The internal corruption within the EEOC has been well documented and demonstrated.

    There are drastic consequences of placing far too much power and authority in the hands of the EEOC when they cannot administer justice responsibly. The American justice system has witnessed the horrifying retreat of facts turned into fantasy. The EEOC has run amok in both Congress and the courts wielding unchecked power and influence. The system is propelled by powerful propaganda, virtually impregnated arrogance, and greed: reason gone mad, zero accountability; and money carries the day. The EEOC is a farce, it perpetuates horrific injustices.

    Well meaning people tell us that “time heals all.” It is a lie, especially when the wound is constantly ripped open by the intentional acts of others in a conscious attempt to hide the truth. Congress needs to step in for there to be any effective changes.

    STUFFED MONKEY ON A NOOSE FOUND IN NEW ROCHELLE, NEW YORK SCHOOL OFFICE

    NEW ROCHELLE – A middle school custodian filed a discrimination complaint against the school district after his supervisor hung nooses in management offices, including one wrapped around the neck of a stuffed monkey.
    Robert Johnson, a night custodial aide at Isaac E. Young Middle School, said plant supervisor Phil Carino had hung three nooses in shared office space, according to a complaint filed with the Equal Employment Opportunity Commission. Johnson said he removed the first, but that Carino defiantly put up two more, the complaint continued.
    Johnson, who is black, said that despite his complaints about the incidents, which occurred between September 2006 and July 2007, school officials failed to seriously reprimand Carino, who is white. Johnson said the district also postponed districtwide racial-sensitivity training, planned for last month.
    “This man can hang up nooses with monkeys, I take it down and he can hang up more and nothing gets done,” Johnson said. “He should be demoted or fired.”
    School board President Cindy Babcock Deutsch said yesterday that the board had filed a “comprehensive” response to the EEOC complaint, but that she could not comment on pending administrative legal actions or personnel matters.
    However, in a statement, she acknowledged that the incidents occurred and said “there were serious consequences for the responsible party … including remedial education and a penalty.”
    Deutsch said sensitivity training for all employees would be held in April and noted that a letter outlining the district’s policy of racial, ethnic, gender and religious tolerance had been sent to employees in October.
    Carino, who Johnson said was suspended for three weeks without pay as a result of the incidents, did not return calls seeking comment.
    The EEOC does not comment on charges when they are in the administrative process, said Nancy Boyd, deputy director of the EEOC’s New York district office.
    Richard Adamson, pastor of Gospel Tabernacle Church of Christ, said he and other community leaders had met with school officials last year to discuss what he labeled as “racist” incidents. He said the district only recently began taking the group’s concerns about sensitivity training seriously after the group threatened to go to the media.
    Adamson is encouraging residents to attend tonight’s school board meeting at George M. Davis Jr. Elementary School to share their views with trustees.
    “That offends every black person,” Adamson said. “The president just made a statement on nooses. The whole country’s taking this seriously. But when we bring this to them, they do nothing about it.”
    “The school board and the superintendent act like it doesn’t exist,” said Ronald Williams, a past president of the New Rochelle chapter of the National Association for the Advancement of Colored People, who also met with district officials. “If this was a swastika, it would have been a totally different reaction.”
    According to the EEOC complaint and copies of internal district documents provided to The Journal News by Williams, Johnson was transferred to Isaac E. Young in September 2006. On his first night there, Johnson said, he noticed a stuffed monkey hanging from a noose attached to a picture board in an office used by Carino and two black supervisors.
    Johnson said he removed the noose and confronted one of the black supervisors, Kenny Bonds, who he said brushed off his concerns. A few months later, Johnson said he saw another empty noose hung from the picture board and removed it. In July 2007, a third noose was hung, which Johnson removed before complaining to Fred Smith, the district’s deputy superintendent.
    According to district documents, the stuffed monkey with the noose had been put there several years earlier by three employees, including one black worker, as a joke with no racist intentions. In the documents, Carino acknowledged that he never took it down and that, after Johnson removed it, he put up the other small nooses. But Carino insisted his actions were not an acts of racism, according to school documents.
    Carino was reprimanded, first with a letter in his file, according to district documents, and later, Johnson said, with a three-week, unpaid suspension. Following the first meeting on the matter on July 24 of last year with Johnson, Carino and other district officials, Principal Anthony Bongo sent a letter dated July 26 to Carino praising his “productive and trustworthy” service, but criticizing him for hanging the nooses.
    “This was clearly poor judgment and I must officially extend my displeasure and reprimand for this episode,” Bongo wrote, adding: “I appreciate your apology to Mr. Johnson, which I believe was heartfelt and sincere. You have owned up to this as a gentleman, as I knew you would.”
    Superintendent Richard Organisciak wrote Carino on Oct. 19, telling him that hanging the nooses was unacceptable, but noting there wasn’t any evidence that he had engaged in “other conduct which created a hostile or unwelcoming workplace.”
    “In considering an outcome, I am giving a great deal of weight to the fact that the monkey and the nooses appear to have been isolated acts, rather than a pattern of conduct on your part,” Organisciak wrote.
    Williams said he had received the letters from district sources, but the district could not verify their authenticity yesterday.
    Johnson said he is considering filing a discrimination lawsuit.
    “I felt they were just trying to ignore the situation and sweep it up under the rug,” he said. “As far as they’re concerned it’s done and over with. It’s not.”

The issue is a greater concern when you have people in supervisory and policy making positions that show actions of bigotry and racism.
    We would think after the cross burning incident in Cortland that our local and state politicians can pass legislation that will protect citizens from crimes such as this.
    Apparently there is a growing epidemic of racial hatred and bigotry with in the Metro New York area. Oct. 9, 2007, a noose was found on the door of Teachers College professor Madonna Constantine who teaches a class on racial justice. On Sept. 11,2007, a group of White men allegedly attacked several Borough of Manhattan Community College (BMCC) Black basketball players and their coach.
    Even African American Law Enforcement Professionals are not immune to the institutional racial bigotry On the morning of Sept. 28, 2007, a janitor found a noose inside a locker room used by police officers at the Village of Hempstead police station in Long Island. Half of the officers serving on the Hempstead Police Department are people of color, 40 percent of which are Black, according to officials. News reports indicate there is suspicion that the target of the noose was newly appointed deputy chief, Willie Dixon who blackWe are almost 50 yrs up from Martin Luther Kings “I Have A Dream” speech. It has become very clear after recent events that the “Dream” has yet to become a “Reality”.

    “…this is not a joke.  Document everything after you file a complaint with EEOC.”While this is a serious admonition that should be respected, it does not go far in guaranteeing that anything fruitful will come out of EEOC or any other government bureaucracy. There is an overly corrupt, gangster-like, systemic arrangement that takes on its own form of life, though started by the thoughts and acts of an evil-minded few taking undue advantage of many.At the second tier level, you have a layer of self-appointed leaders who only go around shouting to the rooftops about being interested in protecting the masses, while many of these despicable folks seek only the protection of their own daily bread. They shout themselves hoarse in the day and crawl to their masters at night to hobnob and seek favor with same corporatists  whose nefarious activities and practices they pretend to condemn in the day! Talk about stinking hypocrisy. Re-read King Saul’s experience and remember how he thought he was playing God by first disobeying Him and then turning around to sacrifice the fattest of lambs which he coveted as spoils of war. Saul was grossly mistaken; as grossly mistaken as misguided self-styled leaders who invariably perceive the people as spoils of war! They will burn here on earth as a prelude to their fate in the life hereafter.  So, you wonder, what is the solution, a solution or a number of solutions? Scrutinize and secure leaders who will be accountable and remain accountable to you and respect that power belongs to you and ultimately to God. How would you know these people? By their works, ye shall know them. Look at what they do, not what they claim. Look at someone like Paul and you do not have to vote for him if you do not believe in him, for whatever reason. The fact remains that the Ron Paul type fits my depiction here. Ron Paul is an example that perfectly fits my characterization of how you know people who are potentially worthy of your choice. This man declined to participate or share in all the opportunistic benefits and arrangements, including cushioned retirements, that legislators reserve for themselves, but never the people who elected them! He has never taken medicare nor medicaid and does not plan to, though he is 76! He is a medical doctor and has served this country in the Air Force. He does not play all the dirty games that the likes of Gingrich and his companions take for granted in politics. How many in this forum are seeking to save this country from a definite path of perdition, but never entertained the idea of looking at examples such as Ron Paul’s in their immediate neighborhoods? I am not saying vote for him or his type; I am just seeking to know how many have not even averred their minds to examining what such people have to offer? If you are one of such, you should look at yourself in the mirror and begin to wonder if you really, truly love yourself, your children and unborn children who are guaranteed vulnerable to these indignities long after you are gone, gone, gone!       God does not come down and exercise His Power. He does so through people; some angels. Be honored to be an instrument in God’s Hands to do His bidding. Remember the story of King Saul, his disobedience to the Word of God, and how he thought he could come around and bribe God! He ended up knowing better, albeit too late. Remember Nebuchadnezzar. Most suddenly, the judgment of God shall pounce on those who pretend to be protecting the people but commoditize them with corporatists for their personal aggrandizement.     In June 2008, Plaintiff (Ricardo Jones) former Senior Federal Investigator EEOC-NYDO was assigned a charge of discrimination to investigate filed by Charging Party, Robert Johnson, a black male custodian, against the New Rochelle City School District. The majority of the students enrolled at the site of the charge are African-Americans and Hispanics. The majority of the staff belongs to the same ethnic. When Mr. Johnson transferred from the administrative office where he held the position of custodian, to the school; he notice three hangman’s knots (Nooses) with a brown monkey (curse george) in the one of the nooses. Mr. Johnson made a complaint to the Acting Superintendent, a black male, but nothing was done initially to resolve it. Mr. Johnson continued protest the hangman’s knots (Nooses) and he removed them himself; however,  The White male supervisor put two more nooses up again in public view for everyone to see. Mr. Johnson took pictures of the hangman’s knots  (Nooses) and gave them to Jones. Jones conducted an on-site investigation for two days.  In interviewing employees, Jones discovered that other discriminatory practices had occurred at the  Middle School and that the hangman’s knots had been on display for a period of seven (7) years. The Acting Superintendent Frank Smith (Black Ph’d) told Jones that an investigation was conducted, but it was not done by him; plus he did not sign-off on the report. He also told Jones that he didn’t know who place his signature on the investigative report. The Acting Superintendent promised plaintiff, when he returned from his honeymoon, he would provide an affidavit. However, when he returned, he was promoted to Superintendent at the Sleep Hollow school district in NY (Weschester County) and failed to submit an affidavit. Dr. Frank Smith who’s father was a lawyer involved in Brown v. Broad of ED. Dr. Who graduated from Howard University.   On June 26, 2008, Nancy Boyd, Deputy District Director, informed Jones that he was being investigated for misconduct. Respondent’s attorney wanted Jones taken off the case because he knew the evidence that Jones discovered during the course of the investigation was going to be damaging to his client. Ricardo Jones was terminated for protecting Black and Hispanic childrens lives and civil rights.

    None of the current Black leaders are concerned civil rights corruption at the federal level because they’re all taking some form of kickbacks. Maxine Water Representative from Compton Ca, was interviewed by Donald Winkfield of Black Star News this month (December) and she said the EEOC is not investigating Black complaints because of the lack of Budget. This is a lie to cover-up for the corruption at the EEOC. Mr. Winkfield told Maxine Waters that the EEOC is dismissing all Black complaints and he has a Senior Federal Investigator who has evidence and witnessed same. Maxine Waters didn’t ask to speak to Ricardo Jones. All of the Black politicians are in on the gaming of Black people. He describes how the EEOC is a cesspool of corruption and racism. Blacks working in the United States have any protection from racial discrimination, because the EEOC unfairly rejects almost 97% of all cases filed by Blacks. Sellout Blacks in the EEOC and racist white workers in the government agency accept bribes and do their jobs in a sexually charged environment where sexual availability and tolerance of racial injustice places folks on the fast track.     The price of moral courage among Black people. There are many of US Blacks who are as guilty as the whites who oppressed US. The truth let it be known to all that color discrimination among the different shades of Black skin is still a problem. The America that I fought for and defended for over twenty year in many foreign countries at risk of my life can accept all people as equals. Today we blame the Mexicans for our lack of Jobs and poor economy. I’ve heard many Black’s talk about the Mexicans like the whites did US before the civil rights act of 1964. I will stand by the Mexicans because they are good hard working people who just want to feed the families and send money back to Mexico where it is needed the most. Many among US Blacks want to step on the necks of the Mexicans because they do day labor from the corners of this so called great country. My Mother came to this so called great country illegally to start a new life and family as the Mexicans did. My Mother’s first language was Spanish also. My Mother and Father were born in Panama and my Great Parents born in Jamaica West Indies. My Great Grand Mother was a White Irish woman who had courage to married a Black Man as many White women did at the time. I have Syrians on my Fathers side of the family. On both sides of my family originally came from Black Africa the source of my families beginnings. I was born in Brooklyn NYC a Black Male and will remain that till the day I die. Many in my family use the status of Black Latinos to their benefit. I have never used same and never will. I could call myself a Black Latino because of my Mother and Father and my name (Ricardo Enrique Jones Sr.). I grew-up in the Hood’s of NYC and SE/NE Washington DC and proud of that. Went to public schools in the aforementioned and Maryland (PG county). The phony president never had and/or learned any of what the Hood taught me about life.     Ikalean,Please forgive me for getting into this discussion so late, but I only recently received membership and I couldn’t keep quiet as I consider the situation in our country to be quite serious. I hear you and I understand your concerns about what Tavis and Doctor West are doing, especially as they are considered to be his traditional “base” of supporters.  But I think a larger issue is getting lost here.While there can be short-term damage to President Obama to have criticism thrown at him from his own presumed constituency, it is also important to recognize that as our President, he is an elected official, and has accountability. The process of election comes from making promises, taking positions, and expressing an agenda, so that voters know what to expect from him if he wins. I’m stating this obvious fact because often in our enthusiasm and passion for having a black family in the White House we forget that Democracy remains healthy and intact only when we question and challenge our elected officials.  To defend or support our leaders unconditionally leads to a recipe for unchecked power, which will corrupt anyone.The other problem we face is that Obama is surrounded by and hit with criticism from the Right constantly and it makes us defensive of him, rightly so. But it also means he is forced to compromise and cater to interests who have not elected him.  Defending him does not ensure he will defend our rights or the programs that bring minorities and poor people to a level playing field with the privileged classes in this country. Washington is an ugly place.  Just ask Jack Abramoff. I am assuming you voted for Obama not because of his color, but because his stated agenda was sympathetic to your concerns. In reality, the agenda that he laid out hasn’t been enacted, and in some ways we have lost more civil rights and economic power under Obama than under Bush. No one should expect 100% return on campaign promises, even amorphous ones like hope and change. But look at the NDAA, the continuance of the Patriot Act, the pardoning of AT&T for illegal wire-tapping, the assasination and detention of U.S Citizens, the refusal to prosecute Wall Street criminals or any Bush administation official for their war crimes and you will see how the state of our democracy is under attack.  You could view this as the nature of politics.  But even Obama stated on election day that change could be made only by all of us pulling together and creating the change we want to see.  You bring about change in your life in your way, and Tavis and Doctor West take another strategy by raising issues in the public sphere that would otherwise go ignored in this contentious political climate.What they are doing, IMHO, is changing the tone of the conversation by pointing to issues that American citizens, regardless of color, deal with, i.e. speaking truth to power.Right now the mainstream media has its lens continually focused on the agenda of right wing adherents who claim entitlement programs, terrorist threats, debt, and immigrants are ruining this country.  Nothing could be further from the truth, I think you could agree with that. However, the establishment and its media would choose to focus strictly on these issues because it makes the Obama Administration look weak and “wrong”.If he caves in to the calls for cutting the social safety net, ramping up the war machine for more attacks in the Middle East, giving corporations, religious institutions and the rich even more rights and powers than they already have, how will that help you?  Will he even be your President anymore?There is already ample evidence that his is not “our” president, but the official who serves the banks and financial services industry, who want as little change as possible.  Only  when he serves OUR interests can we truly say he is our president. Money is a powerful motivator, but speech can be just a powerful.  Numbers count.  If you rally people for your cause and call attention to the numerous crises this country actually faces, that is not “bothering” or attacking the President, it is our responsibility and duty as citizens in a democracy.  This fight is bigger than black on black issues. The Health Care Program was a massive cave-in to the Pharmaceutical and Health Insurance industries and they will profit immensely from it, while the Public Option will remain anemic and largely underfunded if it even gets implemented. The tax incentive is a short term solution that will damage us long-term since the payroll tax is how we fund Social Security.The real battle we face, as you have discussed is for the future of our children.  If you love them, please understand that unflinching support of someone who is betraying your interests will NOT bode well for that future.  If Tavis and Dr. West didn’t bring the issues of poverty and income inequality to the national discussion, who would have done it?  If we still supported the President, and under pressure from the Right and its faithful media (i.e. Fox News), he dismantled our much needed social programs, defunded education, ratched up the War Machine to an even higher level, and violated our Civil Liberties in the name of “National Security” who benefits?  Only the Right, and only the richest among them.Please ask yourself, “When I or my loved ones become homeless and lose access to healthcare, when education becomes so dismal that my children can barely read or write, when our comunities become so impoverished that criminal activity is the number one economic market that rules my streets, can I still in good faith support my President since he is black?”  Community work is vital, but we have enough sense to understand we should be doing that regardless.  This shouldn’t let the President off the hook for his responsibilities.Obama can handle the criticism.  He’s an adult and understands the problems of being the highest profiled and most powerful official in the world. But the office he holds must be examined for its use and abuse of power. Other officials are there because they also represent powerful interests who want things to continue to go their way – or else. Without the voice of the vulnerable and weaker members of society being represented in Washington and on the National scene, who do you think he will be forced to listen to?  This is a war for the future of our country, and we won’t win by leaving Obama alone.  He challenged us to bother him on election day, he asked that we hold him accountable, because the other side will certainly do worse. Public discourse is a largely misunderstood and underused tool that the mainstream media uses to great affect, partially because they downplay its significance.  But we are all affected by it.  It must be challenged and changed, because winning hearts and minds is what politics and power is all about.  Too often we forget that and that is exactly what those in power want us to do. Please step back for a moment and remember that this game is a winner-take-all situation. We can’t let up on Obama any more than the thousands of corporate and big money lobbyists in Washington are letting up on him – and they never will.

     Reply by Bennetta 3 hours ago When I clicked on that ABC story that referenced Sharpton, near the bottom of the article it infers something else too that I really HOPE is not true of Sharpton.BACK TO OBAMA….To be clear, Obama has been a disaster for Civil Rights, Civil Liberties and in part the Economy.  He not only retained most of Bush’s REPUBLICAN policies but actually expanded and/or extended them hence the Patriot Act, warrantless wiretapping, Drones, unauthorized Wars (Libya), NDAA….who knew he loved militancy so much?!  As a Democrat, I certainly did not which is why I voted for him back in 2008 bc I thought he was a DEMOCRAT with democratic values and hence a democratic agenda to include democratic policies for ALL and yes that includes minorities and specifically BLACK communities & THEIR concerns too.  Nonetheless, it appears I and so many other millions of democratic constituents were simply WRONG or shall I say “mislead” to believe that Obama would represent the Left view once in the WH, whereas he instead, shifted from Left to CENTRIST to now appearing to lean Right…certainly not what Democratic voters voted for in 2008….he should NOW be running on the Republican ticket along with the rest because truth be told Obama scares me just as much as those Republicans do! So to ALL who say FOUR MORE YEARS, my response is “ok but this time tell me EXACTLY how will such a vote benefit ME and MY COMMUNITY and OUR concerns?”

    The real concerns of who we are as a ethnic group (Black people) revolves around the exploitation and manipulation of the Black poor and/or the Black working class. The Black middle class have become what they believe to be the Black Elite by titles. The Black Intellectuals have been around from and before reconstruction. We all evolved from the Black poor as a result of some form of Slavery. During Slavery there was the House Negro’s and the Field Negro’s.

    Today we still have the same groups the Black Elitist and Black Intellectuals are the House Negro’s and Black poor and Black working class are the Field Negro’s. The House Negro’s have forgotten where they come from originally the Black poor.

    Many of the House Negro’s pretend to be concern about the Field Negro’s but this is just smoke and mirrors. The question is where and/or whom are the Field Negro’s and are they moving up to become House Negro’s? Are the Field Negro’s just being eliminated and replaced with others?

    The issues that affect us as Black Americans are accountability for all to include the Black Elite and/or Black Intellectuals and the president. If were going to make exceptions for the Black Elite and/or Black Intellectuals then we have only copied and accepted the white racist system. Then we must find someone to oppress to be true little racist bigots. Whom will that be?  Corruption, Racism and Bigotry all go with the system we’re inheriting from our oppressors.  Is this what we inherited from our grand parents and pass on to our grand children?  Ricardo

    EEOC Class Action Backfires; 8th Circuit Sides with Defendant Facing ‘Moving Target’ of Discovery
    A federal appeals court ruling has made it more difficult for the Equal Employment Opportunity Commission to pursue large discrimination cases in the Midwest.The ruling by the St. Louis-based 8th U.S. Circuit Court of Appeals criticized the agency for waiting until discovery to investigate sexual harassment claims on behalf of 67 women in its class action against a trucking company. According to the Associated Press, the EEOC suit “has backfired and put the agency on trial.”The story quotes management side lawyer Gerald Maatman Jr. The opinion is “incredibly significant,” he said. “It is a signal by the federal courts that the tactics the EEOC has been using over the last several years may be improper.”The EEOC filed the suit against interstate trucking company CRST Van Expedited Inc. after receiving a complaint from Monika Starke of Azle, Texas, who claimed one of her trainers made inappropriate comments and another forced her to have sex to get a passing grade.The EEOC first sued on behalf of 270 women, but U.S. District Judge Linda Reade of Cedar Rapids, Iowa, said the agency used “a ‘sue first, ask questions later’ litigation strategy” and barred many of the claims.     The mission of the U.S. Equal Employment Opportunity Commission (EEOC) is to eradicate employment discrimination at the workplace. However, it has been reported that the EEOC fails to investigate the complaints of Black people who file race discriminaton complaints. According to former EEOC investigator (Mr. Ricardo Jones, Sr.) and the EEOC stats, the EEOC dismisses the majority of its race complaint workload.     Thank you Morsie Porter, for having the courage to speak-up. Mr. Hadden is well known for his participation in the cover-up and corruption involving race discrimination. Mr. Hadden lives in a Black community where he has harmed many Black people with his misuse of power. The Black and/or White media won’t address the issues of Racial corruption of the EEOC and/or the government. The current adminstration and the president are part of the problem. obama was one time on the senate commitee that had power to reform the corruption at the EEOC. obama choose to do nothing when Sam Wright Jr., confronted him on the above issues. So as president why do we thing he would do any different than looking the other way on racial issues. Mr. Martin is a supporter of obama. The presidents wife’s girl friend from Harvard Law School is the head of the corrupt EEOC. The rule of law doesn’t apply to US Black people only against US as we have seen in Trayvon’s case. The media have buried their heads in the sand when it comes to the adminstration and racial issues.     The problem is too many people accept the CORRUPTION at the ROGUE EEOC. What this shows is the Government is allowing and/or involved in illegal acts by their officials and attorneys. The Government must be above the rule of LAW? The current adminstration is as guilt as the last adminstration. The president maybe smarter than Bush but he’s also more corrupt.     The Presidents appointee Jacqueline Berrien chair of EEOC is supporting “JIM-CROW II LAWS” at the Rogue EEOC. Black people are not equally qualified for employment by the non-enforcement of the CIVIL RIGHTS ACT OF 1964 as amended by the EEOC. This is what Ms. Berrien has brought to the EEOC nation wide. Ms. Berrien has required the dismissal of a additional 50 complaint per investigator at all EEOC office. If any investigator refuses to dismiss the additional 50 complaints they with be disciplined.

    This is how White Bigots took over the EEOC from Black Bigots. Bigots v. Bogots at the EEOC.
    Joseph Ray Terry had all the right credentials:  as a lawyer, he had spent many years fighting discrimination against minorities.  His employer, the EEOC, had consistently given Mr. Terry “superior” and “excellent” performance reviews.  But Mr. Terry was white, and he was forced to repeatedly sue the EEOC in order to win a promotion for which he had been applying for over 10 years!

    Mr. Terry is a white, Louisiana-trained lawyer.  In 1984 he submitted his first application within EEOC to become a district director for EEOC.  Over the next 10 years EEOC repeatedly turned Terry down because he is white, and EEOC promoted many “disadvantaged minorites” ahead of Mr. Terry, one of whom did not even have a high school diploma

Someone mentioned that I changed a decision according to You tube Bullock v EEOC. This is INCORRECT. I refused to change the decision at the Chair’s direction. The Chair stated “I do not want my sister agency the SEC to suffer.” I said, “what about those women, if I don’t protect them who will? I left for the hospital and Seigal, Abrams and Director Perry changed it. To hell with justice. The EEOC is far to corrupt to help any government employees. It is important to understand their mission statement is irrelevant, the directives to dismiss cases comes from the top down, i.e., the Chair, OGC, Internal Litigation Office of Field Programs etc. The new chair can only perpetuate the old guard. The federal government is the single biggest employer. JOBS are the hottest four letter word. Crippled by the mandated corruption from the EEOC, the federal worked has no where to go for his problems with discrimination and retaliation. So, what is left, a “Stepford” type employee emerges, yes sir, no sir, how high sir – otherwise you will be targeted and lose your job. Who can afford that,so we are left with an outrageous situation wherein the problem cannot be resolved. The EEOC is in desperate need of a Change Agent. Plaintiff alleges that Defendant Nancy Boyd, public official at the EEOC–gave “Hershey Bar Candy wrapped with EEOC wrappers to EEOC investigators who dismissed the most cases.” Plaintiff alleged EEOC officials often dismissed cases bases on statistics without looking at other evidence to support dismissal.

    This is the get out of jail free card which allows the EEOC to commit crimes, frauds and take bribes. The president can correct this with an executive order if he’s honest.     Following law school, Michelle worked as an associate in the Chicago branch of the law firm Sidley Austin in the area of marketing and intellectual property.     The real concerns of who we are as a ethnic group (Black people) revolves around the exploitation and manipulation of the Black poor and/or the Black working class. The Black middle class have become what they believe to be the Black Elite by titles. The Black Intellectuals have been around from and before reconstruction. We all evolved from the Black poor as a result of some form of Slavery. During Slavery there was the House Negro’s and the Field Negro’s.

    Today we still have the same groups the Black Elitist and Black Intellectuals are the House Negro’s and Black poor and Black working class are the Field Negro’s. The House Negro’s have forgotten where they come from originally the Black poor.

    Many of the House Negro’s pretend to be concern about the Field Negro’s but this is just smoke and mirrors. The question is where and/or whom are the Field Negro’s and are they moving up to become House Negro’s? Are the Field Negro’s just being eliminated and replaced with others?

    The issues that affect us as Black Americans are accountability for all to include the Black Elite and/or Black Intellectuals and the president. If were going to make exceptions for the Black Elite and/or Black Intellectuals then we have only copied and accepted the white racist system. Then we must find someone to oppress to be true little racist bigots. Whom will that be?  Corruption, Racism and Bigotry all go with the system we’re inheriting from our oppressors.  Is this what we inherited from our grand parents and pass on to our grand children?

    Ricardo Jones claims none of this takes place for far too many race discrimination cases filed by African-Americans. According to Jones, an EEOC insider and Whistleblower, who was employed by the New York City Office Equal Employment Opportunity Commission for nine years, “only 1% of the complaints made to the EEOC get investigated dan others (typically those made by African Americans are thrown into the garbage or labeled ‘unfounded.’” Instead of conducting proper investigations, the was just handing out EEOC Right to Sue’ letters.”

    Jones, whose job was to investigate mostly private sector workplace complaints, was the only investigator in his office who refused to dismiss all Black complaints as ordered by his managers and supervisors and this is one of the reasons that he was fired.

    Jones asserts that any complaint filed by an African American–no matter if they were employed by the city, state, federal or private sector–was labeled a “C” (A “C” means an automatic “DISMISSAL”) and the case or file is thrown into the garbage. Not only did EEOC label ALL complaints by African Americans a “C” – they also violated their own policies and procedures to issue a (PDI) pre-determination interview, when they failed to notify African American complainants that no findings of discrimination were found in their cases. On top of that, ‘Right to Sue’ your employer letters were only issued after 180 days but most of the time African American complainants never received any type of pre-determination notices before their cases were dismissed by the EEOC. Jones stated “since the EEOC is not going to investigate your case anyway, all African Americans and others should always just ask for a ‘Right to Sue’ letter –a few days after filing a complaint with EEOC, which is well in their rights.”
    He alleged that the agency gave these cases are always met with “lazy investigative work”.  How can the EEOC say that workplace discrimination did not occur simply because the complainants were African Americans and then not even bother to inform complainants of their findings?

    We have come to a point where no matter who’s running our government its a corrupt gangster government. The people we elect believe they have the right to protect the corrupt institutions of corrupt power. Very few corrupt appointee’s have been disciplined to deter others. Corruption is the rule not the exception. We have only economic clout to voice our issues and concerns. We have 42 useless Black Representatives (435) in the House on capital hill. Those 42 represent whites over the Blacks who elected them. The question is why do we accept the aforementioned. We have no Black Senators (100) and only had 6 Black Senators in history to include President Obama. What is the state of Black America today and in the future? 13.4% Black unemployment while White unemployment is 6.8% ! Second Class Citizenship for most of US.

    Many Black people live in and have friends/family in the 7th Congressional District represented by Elijah Cummings. Representative Cummings is the ranking member of the House Committee on Oversight and governmental Reform. He has the authority to conduct hearings on the fraud and corruption at the EEOC, MSPB, OFCCP, DOL, OSC and DOJ office of CR mainly affecting Black People.

    The Committee on Oversight and Government Reform is the main investigative committee in the U.S. House of Representatives. It has jurisdiction to investigate any federal program and any matter with federal policy implications. His area covers Baltimore City, Baltimore county and Howard County to include Columbia, Laurel and Jessup MD. Why hasn’t Representative Cummings addressed the above issues? He was one the main sponsors of the Lilly Ledbetter Executive Order covering Equal Pay Act issues for a White Woman from Alabama.

    Is it because the EEOC is a Black Seat for a set a side for the appearance of change in this countries history of Bigotry and racism. No moral courage and no one in a position of authority can and/or will stop the mis-conducts/corruption/fraud going on at this rogue agency. Overtime funds used for managers travel not the back log of complaints which will only be dismissed anyway. Managers family members hired as consultants and paid at the EEOC. Managers with private consulting firms doing follow-up training. Cases fixed for Attorneys and Management friends at the EEOC. Local attorneys in FEAR of fighting the corruption at EEOC-NYDO. Everyone in the local NYDO area knows the FIX is in at the EEOC-NYDO. The corruption is not only in NYDO but in Washington and the rest of the EEOC also. Manager/attorneys/investigators paid bonuses to dismiss complaints.
